This privacy policy applies to all services, websites and agreements of Wheels 'N Customs V.O.F. In it, we explain in detail how we handle your personal data and ensure that it is treated confidentially and in strict accordance with applicable privacy legislation.

Article 1 – Identity of the data controller

Wheels 'N Customs is the data controller for the processing of personal data as set out in this privacy and cookie statement.

Article 2 – Which personal data we process

We process your personal data because you use our services (such as visiting our web shop or workshop) and/or because you actively provide this data to us yourself.

The data we process includes, but is not limited to:

• First and last name;
• Address details (billing and delivery address);
• Telephone number and email address;
• IP address and unique device data (browser, operating system);
• Payment details (processed in anonymised form via our payment providers);
• Vehicle data (such as registration number, car make and model for fitment guarantee);
• Customer service history and purchase history.

Article 3 – Purpose and legal basis of data processing

Wheels 'N Customs processes your personal data on the basis of the following legal grounds:

• Performance of the contract: For processing your order, payment, shipping and logistics, fitting appointments, and the handling of customer service, returns or warranty issues.
• Legal obligation: We process personal data that we are legally required to retain, such as invoice details and purchase history for our tax returns and administrative obligations with the Dutch Tax and Customs Administration (Belastingdienst).
• Legitimate interests: For website optimisation, technical support, and the detection and prevention of fraud or spam in our systems.
• Consent: For sending targeted offers or placing marketing cookies, we first request your explicit consent.

Article 4 – Sharing personal data with third parties

Wheels 'N Customs never sells your personal data to third parties and only discloses it if this is strictly necessary for the performance of our contract with you, or to comply with a legal obligation. In specific cases, we share data with the following categories of third parties:

• Logistics partners: We share only the necessary name and address details and contact information with carriers (such as DPD, Packs and GLS) to deliver your order and provide you with shipping updates.
• Payment service providers (PSPs): We share data with payment services (such as iDEAL, PayPal or credit card companies) for the secure processing of your financial transactions. If you choose to pay later via Klarna, you share your data with Klarna and they independently carry out an identity and credit check under their own privacy policy.
• IT service providers: We share data with software suppliers (such as our web hosting, accounting software and customer service tools) who process data on our behalf. We have concluded strict data processing agreements with these parties to safeguard the security of your privacy.

Article 5 – Retention periods

We do not retain your personal data longer than is strictly necessary to achieve the purposes for which your data is collected.

• Tax administration: Tax data, including invoices, payment details and order history, is legally required to be kept for 7 years to meet the requirements of the Tax and Customs Administration.
• Customer accounts: Customer account data (if created) is retained until you delete the account yourself or ask us to do this for you.
• Customer service: Customer service history, email correspondence and submitted documentation (such as photos for warranty purposes or damage reports) are kept for up to 2 years after the last interaction to properly handle any later claims or disputes.

Article 6 – Cookies and similar technologies

Wheels 'N Customs uses functional, analytical and tracking cookies to ensure our web shop operates optimally and is improved. A cookie is a small text file that is securely stored in your computer, tablet or smartphone browser on your first visit to our website.

• Functional (Necessary) cookies: These cookies are strictly necessary for the technical operation of the website and your ease of use. They ensure the website functions properly and remember, for example, your preferred settings and the contents of your shopping basket during checkout. No prior consent is required for this.
• Analytical cookies (GDPR-compliant): We use analytical tools (such as Google Analytics) to collect anonymised statistics about how visitors use our web shop. We have configured Google Analytics in a privacy-friendly way: IP addresses are anonymised (masked), a data processing agreement has been concluded with Google, and we do not share any further data with Google for other services.
• Marketing and tracking cookies: These cookies are used to track your browsing behaviour so that we can offer tailored content and relevant advertisements (e.g. via Facebook/Meta or remarketing networks). We also use third-party cookies (e.g. for Trustpilot reviews or embedded YouTube videos). These marketing cookies are only placed after you have explicitly consented to them via our cookie banner.
• Withdraw consent / Delete cookies: You can withdraw your consent at any time or opt out of cookies by setting your internet browser (Chrome, Safari, Edge, Firefox) so that it no longer stores cookies. In addition, you can easily delete all information previously stored via your browser settings.

Article 7 – Access, rectify or delete your data (Your rights)

You always retain full control over your own personal data. Under the General Data Protection Regulation (GDPR), you have the following rights:

• The right to access, correct or have your personal data deleted (the so-called right to be forgotten).
• The right to withdraw any prior consent for data processing or to object to the processing by Wheels 'N Customs.
• The right to data portability, which means you can submit a request to have the personal data we hold about you sent to you in a computer file.

Requests regarding your personal data can be sent to info@wheelsandcustoms.nl. To ensure that the request for access was indeed made by you, we may ask you to provide identification for verification. We will respond as soon as possible, but no later than within four weeks, to your request. You also always have the statutory option to lodge a complaint with the national supervisory authority, the Dutch Data Protection Authority (Autoriteit Persoonsgegevens).

Article 8 – Data security

• Wheels 'N Customs takes the protection and security of your personal data extremely seriously. We continuously take appropriate technical and organisational security measures to prevent misuse, loss, unauthorised access, unwanted disclosure and unauthorised alteration of your data.
• The entire website, all checkout environments and all underlying data traffic are protected with robust SSL encryption (HTTPS).
• If you nevertheless have the impression that your data is not properly secured, or there are indications of misuse in your account, please contact our customer service immediately.

Article 9 – Changes to this policy

Wheels 'N Customs reserves the right to amend this privacy and cookie policy if new legal provisions or business processes so require. The most current version of our policy can always be found on this page of the web shop. We advise you to consult this policy regularly so that you are always aware of any changes.
